DRUG TESTING REGULATION UPDATE

DIRECT OBSERVATION

Memorandum issued by IBT Director of Safety and Health Department and reads as follows:

   This memorandum is to advise you that the Court of Appeals issued an administrative order to stay the November 1, 2008, effective date of the regulatory revision to the Department of Transportation drug testing regulation 49 CFR Part 40.67. The regulatory revision will not become effective until the Court rules on the merit of the motion filed by the International Brotherhood of Teamsters and other stakeholders regarding the appropriateness of the regulatory revision.

   On June 25, 2008, the Department of Transportation (DOT) issued a final rule regarding revisions to the urine drug specimen collecion process that would have required that all Commercial Driver's License (CDL) qualified drivers who are subject to return to duty testing or unannounced follow up testing, provide urine specimens while being directly observed by the specimen collector. The final rule also provided specific instructions regarding how the direct observation process should be conducted.
